New Delhi, May,10 (UNI) A Delhi court, after hearing final arguments in a 25-year-old case, acquitted three persons -- a man, his wife and their son -- in a cheating case.

Judicial Magistrate First Class, Dr. Aneeza Bishnoi after hearing argument on behalf of prosecution and defence counsel said," The discrepancies in the prosecution version create doubts. It is a settled position of law that the onus and duty to prove the case against the accused is upon the prosecution, which must establish the charge beyond reasonable doubt. However, it has failed to do it in the present case. The accused are entitled to the benefit of the doubt in the present case".

The accused -- Vatan Bir Singh, Tasveer Singh and Jagjeet Kaur -- were acquitted of the offences punishable under various sections of the IPC", the court said.

The case of the prosecution was that on or before August 16, 2000, the accused cheated the complainant (as per the charge-sheet) by alluring him to deliver Rs. 14 lakh on the basis of false and fabricated documents pertaining to the sale of a property in Paschim Vihar, Delhi.

The accused Jagjeet Kaur was found to be not the original owner of the property and thereby committed an offence punishable sections 420/120B IPC. The court said, "The evidence led by the prosecution is not sufficient to convict the accused persons, for the reasons discussed hereinafter".

The court said, "Not even a single document has been placed on record by the prosecution to support their allegations against the accused persons."
