Delhi Court directs registration of FIR against trainee IPS officer, others

New Delhi, May 6 (UNI) A court in Delhi directed the police to register a First Information Report (FIR) against a trainee Indian Police Service (IPS) officer and others for allegedly smashing a whiskey glass on the forehead of a man during an event in Kapashera on December 6, 2024.
Judicial Magistrate First Class (JMFC) Nidhish Kumar Meena in its order on May, 3 said, " I am of the considered view that prime facie cognizable offences have been committed by the alleged accused persons.
The investigation in the present matter is necessary as the complainant is not in the position to collect all the evidences pertaining to the accusations made against the alleged accused persons and identity of all the alleged accused persons is yet to be ascertained.
Further, the allegations are also serious as the injury has been caused on the vital part of the body i.e. head and the interest of justice demands that the through investigation be conducted to unearth the truth in the facts and circumstances of the case".
"Accordingly, the SHO, PS Kapashera concerned is directed to register an FIR against all the alleged accused persons including Rahul Balhara, Ashwani Balhara, Vivek Chaudhary, Kallu and others under appropriate provisions of law and file copy of FIR at 10.00 AM on 05.05.2025.
A copy of this order be sent to SHO concerned for compliance", the court said.
The complainant, Vikas Dhayal, a civil service exams coach moved an application seeking registration of FIR by alleging that on 06.12.2024, the complainant alongwith his friends and alleged accused persons were attending one ceremony at Manaktala Farms, Kapashera, New Delhi.
At around 10.30-10.45 PM, proposed accused Rahul Balhara was having arguments with complainant’s friend Rahul Dabas and when complainant intervened and tried to pacify, Rahul Balhara started abusing and gave life threats to the complainant.
Rahul Balhara’s friend Vivek Chaudhary also came there and threatened and abused the complainant.
He further alleged that accused Rahul Balhara smashed the whiskey glass on the forehead of the complainant and due to the impact of the hit, the complainant fell down on the ground and glass severed his skin and blood started to ooze out from his head.
It is further alleged that the alleged accused persons did not stop there and Rahul Balhara alongwith Ashwani Balhara, Kallu and his friends started kicking and slapping on complainant’s head, face and ears mercilessly while exhorting “saale ko aaj jaan se maar do”.
Counsel for complainant submitted that the friends of the complainant took him out from the venue in fear as there was threat to his life.
They took him to the Manipal hospital, Gurugram for the treatment. Thereafter, one of the complainant’s friends dialed number 112 and ASI Basant Kumar came at the hospital in the car of . Rahul Dabas.
It is further alleged that ASI Basant Kumar tried to pressurise the complainant and his friends owing to the pressure from the senior officers as the alleged accused Rahul Balhara is an IPS officer.
It has also been alleged that the complainant alongwith his friends and police officials visited the place of the incident, however, police officials did not bother to collect any piece of evidence including the weapon of offence.
Counsel for complainant submitted that instead of recording of his correct and complete statement, police officials started to threatened the complainant, his friends and family members to not pursue the case in the pressure of alleged accused person Rahul Balhara, as he is an IPS officer and the senior officers are supporting him.
It is also submitted that feeling being hopeless, harassed and threatened, the complainant uploaded the CCTV video wherein Rahul Balhara can be seen hitting on complainant’s head and tagged Delhi Police and as the media started covering it, police gave the notice to the complainant to join the
investigation and consequently NCR bearing no. 56/2024 was registered against the proposed accused persons.
The Complainant submitted that aggrieved by the action of the police for merely registering non-cognizable report and not an FIR, the present application has been moved by the complainant.
