Magistrate warns accused of action before NCW for intimidation & harassment

New Delhi, Apr 21 (UNI) A Magistrate court here has convicted a man in a cheque bounce case and warned him of appropriate action against him before the National Commission for Women for alleged threats and harassment.

Judicial Magistrate First Class Ms Shivangi Mangla had convicted the accused for offence punishable under Section 138 (dishonour of cheque) of the Negotiable Instruments Act and directed him to furnish bail bonds under Section 437A CrPC on the next date of hearing.

The court while passing the conviction order on April two, 2025 said, "In compliance of order dated March 26, 2025 and further considering pendency of matter for more than five years, the court deems it fit to proceed with pronouncement of judgment. Vide separate judgment of even date, accused is convicted for offence punishable under Section 138 NI Act. Accused is directed to furnish bail bonds under Section 437 (A) of CrPC on next date of hearing."

After hearing the ruling, the accused erupted in anger and started harassing the judge in open court by hurling abuses at the judge and also tried to throw an object at the judge for not passing order in his favour.

Then, the accused ordered his advocate to do anything to get judgment in his favour. So, they both started mentally and physically harassing the judge demanding to acquit the accused, else they threatened to file a complaint against the judge and forcibly arrange her resignation.

Without succumbing to their pressure tactics, the judge warned that she will take appropriate measures against the accused before National Commission Woman, Delhi for such threatening and harassment.

After hearing arguments on quantum of punishment on April five, the judge said, "... considering the pendency of the matter since 2019 and the age and financial ability of the convict, this court is of the considered opinion that interest of justice shall be met in this case by sentencing the convict to simple imprisonment for period of 22 months and fine of Rs 6.65 lakh."
