SC grants Union of India 3 months to report on delimitation in Northeastern states

New Delhi, Mar 17 (UNI) The Supreme Court on Monday granted the Union of India three months to furnish details on the steps taken to carry out the delimitation exercise in the northeastern states, particularly Arunachal Pradesh and Nagaland, following the rescission of their deferment through a Presidential order in 2020.
A bench, comprising Chief Justice of India Sanjiv Khanna, Justices Sanjay Kumar and Joymalya Bagchi, was hearing a petition seeking delimitation in four northeastern states—Manipur, Assam, Nagaland, and Arunachal Pradesh.
The Court sought clarification from the Election Commission of India (ECI) regarding the progress of conducting the delimitation process.
Under Section 8A of the Representation of the People Act, 1950, the President can rescind a deferment order issued under Section 10A of the Delimitation Act, 2002, if conditions in these states are deemed conducive for the exercise.
The petitioners argued that since the Presidential order dated February 28, 2020, lifted the deferment, the government was obligated to proceed with the delimitation in these states.
The petition highlighted that despite a March six, 2020, notification constituting a Delimitation Commission under retired Justice Ranjana Prakash Desai for Jammu & Kashmir and the four northeastern states, the exercise was ultimately conducted only for Jammu & Kashmir.
The petitioners further contended that repeated memorandums submitted to the Prime Minister in 2021 and 2022 went unanswered, amounting to a violation of Article 14 of the Constitution by denying these states equal treatment.
It was also emphasized that parliamentary and assembly elections have been successfully conducted in these states since 2002, without any significant law-and-order issues that would justify the continued delay in delimitation.
The plea urged the Court to direct the government to conduct the delimitation either through a new commission under the Delimitation Act, 2002, or under Section 8A of the Representation of the People Act, 1950, through the ECI.
