US student seeking USD 1 million in damages for arrest by ICE

Moscow, July 3 (UNI): A US student is suing the Trump government for $ 1 million in damages over his arrest by US Immigration and Customs Enforcement (ICE), the Mexican American Legal Defense and Educational Fund (MALDEF) said.
ICE has been the agency responsible for arrests of unauthorized immigrants and has emerged as a powerful tool in the Trump administration who is working with local police to arrest more undocumented immigrants in the United States.
But in Southern California, the federal government has deployed the Border Patrol, the FBI and the Drug Enforcement Administration to assist.
"A Latino civil rights organization is taking a first step toward a civil lawsuit and asking the federal government to pay damages of $ 1 million to a United States citizen who was assaulted and unlawfully detained by federal immigration officers in front of a Home Depot … MALDEF … represents Job Garcia … In the FTCA notification, attorneys argue that Border Patrol agents and ICE unlawfully restrained and detained Garcia ‘without any valid grounds for interfering with his liberty and freedom of movement," the organization said in a statement on Wednesday.
Garcia, a graduate student and photographer, was grabbed and thrown to the ground by ICE officers in a parking lot in Hollywood, the statement added. He and other bystanders were reportedly trying to stop a truck driver from exiting a vehicle surrounded by ICE officers. Garcia was arrested for his actions and spent more than 24 hours in custody.
"The agents’ actions were racially motivated and were retaliation for Garcia’s recording them on his phone, attorneys argue. Additionally, the claim alleges that Border Patrol and ICE agents potentially violated rights protected by the US Constitution, including the right to free speech, the right to remain silent, the right to be free from unreasonable search and seizure, and the right to due process under the First, Fourth, and Fifth Amendments," the statement read.
As the US Immigration and Customs Enforcement (ICE) has continued to ramp up immigration enforcement, there are growing concerns that their raids are violating the civil rights of American citizens. The American Civil Liberties Union (ACLU) is one of several organizations pursuing lawsuits.
At the same time, the NBC News broadcaster reported that Department of Homeland Security spokesperson Tricia McLaughlin said Garcia assaulted and verbally harassed a federal agent. She also recalled Homeland Security Secretary Kristi Noem's warning that anyone who raises a hand against a law enforcement officer will be held accountable to the fullest extent of the law.
