Amnesty, Aakar Patel receive temporary relief

Bengaluru, April 28 (UNI) The Karnataka High Court on Monday granted an interim stay on proceedings initiated under the Prevention of Money Laundering Act (PMLA) against Amnesty International India Pvt Ltd (AIIPL) and its former director, journalist and author Aakar Patel.
The stay is effective until the next date of hearing.
Justice Hemant Chandangoudar issued the interim order after hearing the petitioners’ counsel, who argued that a coordinate bench of the court had earlier granted an interim order in a similar case involving one of the accused, G Ananthapadmanabhan, in Criminal Petition. The petitioners contend that the allegations against Aakar Patel and the other accused are similar, thus justifying a similar relief.
The petitioners approached the court seeking to quash the complaint filed by the Enforcement Directorate (ED) on May 27, 2022, under sections 44, 45(1), 3, 70, and 4 of the PMLA. They also sought to set aside the order of the special court, dated June 2, 2022, which took cognisance of the case against them as accused number 1 and 4.
The case stems from an ED investigation based on a CBI FIR alleging violations of the Foreign Contribution (Regulation) Act (FCRA), 2010, and criminal conspiracy under Section 120B of the Indian Penal Code (IPC).
The Enforcement Directorate claims that in 2011-12, the Amnesty International India Foundation Trust (AIIFT) was granted permission to receive foreign contributions from Amnesty International, UK, under the FCRA.
However, this permission was revoked due to adverse inputs. Subsequently, two new entities, AIIPL and IAIT, were allegedly formed in 2013-14 and 2012-13, respectively, to circumvent the FCRA route and continue receiving foreign funds under the guise of service exports and Foreign Direct Investment (FDI).
Amnesty International India has denied the money laundering charges, calling them "patently untrue."
The next hearing is expected to take place in the coming weeks, with the court set to examine further developments in the case.
