Himachal Govt notifies premium FAR for parking in buildings abutting roads

Shimla, June 17 (UNI) The Himachal Pradesh Government has notified the draft of the Himachal Pradesh Town and Country Planning (Fourteenth Amendment) Rules, 2025, providing major relaxations and enabling provisions for parking infrastructure in buildings situated along the roads, an official said today.
The move comes amid increasing concerns over urban congestion, especially in the state capital, Shimla.
On weekends, Shimla witnessed traffic chaos with over 1.10 lakh vehicles entering the city, despite the city having parking capacity for just about 5,000 vehicles. The recent policy shift aims to ease such pressure by allowing additional Floor Area Ratio (FAR) for parking provisions in residential and commercial buildings, including old constructions located along roads and highways.
A significant breakthrough came after the Supreme Court quashed the 2017 National Green Tribunal (NGT) order that had restricted construction to two-storey buildings, discouraging parking development within building structures.
Following the apex court’s green signal to implement the new Shimla Development Plan, the government has now included specific provisions for open-to-sky and basement parking in the amended rules.
As per the notification, temporary steel-frame parking platforms will be permitted on 50% of the frontage within the setback, especially for buildings on the valley side, subject to structural safety and disaster management clearance.
The conversion of closed basement floors for parking will also be allowed on payment of Rs 1,500 per sq.m, while misuse of such designated parking for residential or commercial use will invite a fine of Rs 3 lakh, and Rs 5 lakh for repeat violations.
The new rules also lay out a fee structure for obtaining Premium FAR for commercial use, including tourism, based on the width of the abutting road and area of the plot. However, this facility would not be applicable in sensitive planning areas like Shimla, Kullu Valley, Dharamshala, and Kasauli.
The government has further introduced accountability measures for professionals involved in planning approvals, empowering the TCP Director to suspend or cancel their registration and impose fines up to Rs 2 lakh for regulatory violations.
With these amendments, the state aims to address unplanned parking and promote safer, regulated development along its urban and tourist corridors. UNI ML SSP
