Himachal HC pulls up DC for vague affidavit in encroachment case, summons him

Shimla, July 3 (UNI) The Himachal Pradesh High Court expressed strong dissatisfaction over the affidavit filed by the Deputy Commissioner of Bilaspur in a public interest litigation concerning unauthorized constructions on land falling under the National Highways Authority of India (NHAI) jurisdiction.
The division bench comprising Chief Justice GS Sandhawalia and Justice Ranjan Sharma, while hearing CWPIL No. 4 of 2024 (Madan Lal vs Union of India), noted on July 1 that the affidavit of June 28, 2025, lacked crucial details, including the identity of the encroachers, the nature and age of the encroachments, and their impact on the new highway project.
The Deputy Commissioner had submitted that joint inspections were conducted with the Special Land Acquisition Unit and sub-divisional officers based on a list provided by the NHAI's project director, Mandi. He stated that action against violators would follow due process under the NH (Land & Traffic) Control Act, 2002, once eviction orders were obtained from the competent authority.
However, the court found the response inadequate in light of its earlier order dated April 10, 2025, and said the officer appeared to have neither read the order seriously nor understood the gravity of the matter.
“We are disappointed… apparently the said Officer has not gone through the said order and realised its implications,” the bench remarked.
The court has now directed the Deputy Commissioner to appear in person on July 21, 2025, and submit a revised and comprehensive affidavit demonstrating respect for the judicial process.
Advocate Umesh Kanwar appeared for the petitioner, while counsel representing the Union, State, and NHAI were also present during the hearing.

Lucknow, July 3 (UNI) The Uttar Pradesh excise department is elated with its achievement in revenue collection in the first quarter of the current fiscal. UP Minister of State (independent charge) Nitin Aggarwal said here today that the excise department collected Rs 14,400 crore in the first quarter of this fiscal, which is around 98.8% of the target and was Rs 2,445 crore more than the revenue of Rs 11,783.76 collected in the same period in 2024-25.
