Jharkhand HC completes hearing on JSSC-CGL cancellation

Ranchi, Oct 8 (UNI) The Jharkhand High Court on Thursday completed hearing on petitions challenging the state government’s decision to cancel the JSSC-CGL examination conducted under Advertisement No. 10/2023, with the parties presenting their respective arguments before the court.
The hearing took place before Justice Deepak Roshan on petitions filed by candidates including Akash Gaurav and Niroj Khes.
Senior advocate Meenakshi Arora, appearing for the state government through video conference, said the examination was cancelled following large-scale irregularities and alleged corruption.
She claimed that serious deficiencies in the arrangements made by the agency conducting the examination had allowed the question paper to be leaked.
According to the government, some candidates were allegedly taken to Nepal and other places where they were made to memorise answers to questions. The government said the investigation was still underway and had so far found evidence indicating irregularities.
The state argued that it was difficult to identify which candidates had benefited from the alleged irregularities and which had appeared in the examination without any advantage.
It said the Cabinet therefore decided to cancel the entire examination to protect the credibility of the recruitment process.
During the hearing, the court questioned the delay in the investigation and asked why an FIR or zero FIR had not been registered when the alleged question paper leak first came to light.
Advocate Harsh Kumar, appearing for an intervener, supported the government’s decision and described the episode as a systemic failure. He alleged that a blacklisted agency had been entrusted with conducting the examination.
However, advocate Amritansh Vats, representing candidates who had cleared the examination and were already working, challenged the government’s authority to cancel the examination and related advertisement.
He argued that the appointments had been made under an order of the Governor and cited earlier Supreme Court judgments on cancellation of examinations affecting large numbers of candidates.
Further hearings in petitions concerning JPSC examinations, including CDPO, 11th-13th Civil Services and Food Safety Officer examinations, are scheduled for October 9.
