‘CM office is not so fragile that an invective can shake it’: Madras HC raps Vijay govt, grants advance bail to DMK Councillor

Chennai, Nov 3 (UNI) Reprimanding the Tamil Nadu police and rapping the Vijay government over a case registered against a DMK ward councilor for making derogatory statements about the Chief Minister and the ruling Tamilaga Vettri Kazhagam (TVK), Madras High Court granted anticipatory bail to her, observing, “The office is not so fragile that a Ward Councilor’s invective at a party meeting can shake it.”
“The State diminishes the office it claims to protect when it answers words of that kind with the machinery of arrest,” Justice N Ramesh further observed, taking issue with the FIR registered against D Sudha, adding, “The machinery of criminal law could not be deployed merely because political speech offended those holding public office. The police serve the State, which endures, and not the party in government, which changes.”
A councilor of the Greater Chennai Corporation and a DMK Women’s Wing functionary, Sudha was booked over a speech on October 7 in which she allegedly referred to the Chief Minister as a ‘do’ and a ‘corpse’. A complaint was lodged by a TVK functionary 12 days later.
