Dwarka court rejects Exusia discharge plea

Dwarka, Apr 15 (UNI) In a pivotal ruling, a court here on Tuesday dismissed the discharge application filed by the accused, Trevor Silver (CEO) and Harpreet Mehta (COO) of Exusia India Private Limited, in the ongoing defamation case brought forward by Rajneesh Kumar, a former senior executive of the company.
The accused had sought to be discharged from the case, arguing that Rajneesh Kumar, who had worked at various senior positions within the company, was a disgruntled employee seeking to harass them through legal means.
The court, however, rejected the application, citing the Supreme Court's decision in Subramanyam Sethuraman versus State of Maharashtra, which establishes that discharge applications cannot be filed at the summons triable stage under Section 251 of the Criminal Procedure Code (CrPC).
The court emphasised that such relief can only be pursued before the High Court under Section 482 CrPC.
Additionally, the bail bonds submitted by the accused were found to be unsatisfactory. The surety for Harpreet Mehta, Syed Salimuddin, could not provide a verifiable address, and the surety for Silver, Purushottam, admitted to not knowing the accused personally.
Consequently, the court rejected the bail bonds and granted the accused additional time to submit fresh sureties.
Rajneesh Kumar’s case stems from his wrongful termination and public defamation by Exusia India, with the company posting defamatory messages on social media to allegedly protect its image.
Despite facing defamation and harassment, Rajneesh has remained resolute in his fight for justice, highlighting the need for greater protection against unethical corporate practices.
The court has set the matter for the framing of notice on May 24, signaling the continuation of the legal proceedings.
Exusia India Private Limited is the Indian subsidiary of Exusia Inc, a US-based technology consulting firm founded in 2012 by Trevor Michael Silver and Amy Wagner. The company is headquartered in Miami, Florida, and operates globally, including in Pune, where its Indian operations are based.​
