HP HC halts State’s move to take over Baira Siul Hydro Project

Shimla, Apr 25 (UNI) Single Bench of Himachal Pradesh High Court comprising Justice Ajay Mohan Goyal stayed the state government's move to take over the 180 MW Baira Siul Hydro Power Project, currently operated by NHPC.
This interim order comes after a petition by NHPC, which is contesting the state’s takeover bid.
The Baira Siul project, commissioned in 1980-81, was to be returned to the state after 40 years, as per the original agreement. With the completion of this period, the state initiated steps to reclaim the project. However, NHPC has contested this, claiming perpetual ownership after modernizing the project in August 2021.
During the hearing on April 22, senior counsel Tushar Mehta represented NHPC via video conferencing. The court has ordered to maintain the status quo on the project and stayed the state's communications and Cabinet decisions regarding the takeover until further notice. The next hearing is scheduled for May 26.
The state is also eyeing the return of two other central projects—NHPC's Duggar Project and SJVN’s Luhri and Dhaulasidh Projects. The central government has demanded Rs. 3,400 crore invested in these projects, while the state plans to appoint an independent evaluator to assess their value.
