HP: Non-complaint CS to appear in HC

Shimla, May 8 (UNI) The Himachal Pradesh High Court has summoned the State's Chief Secretary Prabodh Saxena for failing to comply with its orders.
The court warned that if the directions are not followed within a week, the Chief Secretary would have to appear in person.
A division bench of Justices Tarlok Singh Chauhan and Sushil Kukreja expressed displeasure, observing that despite its previous orders, no alternative land has been allotted to the petitioner in the last six years, nor has any action been taken under the law to acquire the original land.
The case pertains to Suleman, a member of a poor family residing in Baddi, who had filed a petition in 2019 after the Baddi-Barotiwala-Nalagarh Development Authority (BBNDA) installed a solid waste plant near his residence without seeking consent as mandated under the solid waste policy.
The court had earlier ordered the government to allocate alternative land to Suleman so he and his family could live peacefully.
In the same matter, the Deputy Commissioner of Lahaul-Spiti has submitted an affidavit in compliance with the court’s earlier order dated July 18, 2023. The court also raised concern over the use of green tax funds collected from tourists entering Lahaul-Spiti, Atal Tunnel, and Kullu-Manali.
It has now directed the Chief Secretary to file an affidavit detailing how the funds collected under green tax are being utilized.
The High Court emphasised that green tax revenue should be used exclusively for cleanliness, garbage disposal, and related maintenance works, not for salaries or unrelated expenses.
The next hearing in the matter has been scheduled for May 13.
