Islamabad, May 11 (UNI) The Islamabad High Court has rejected Khyber Pakhtunkhwa Chief Minister Asif Ali Amin Gandapur’s petition for the release of former PM Imran Khan from Adiala Jail.
Gandapur’s petition, which sought the release of the former PM under parole, was dismissed for not fulfilling basic legal requirements.
The Registrar Office objected that the plea was not filed by the aggrieved individual himself and failed to name Khan as a party in it.
Additionally, the National Accountability Bureau (NAB) — the prosecuting authority in the case in which Khan is serving the sentence — was not listed as a respondent, reports Dawn.
The registrar noted that the full addresses of the parties involved were absent and expressed concerns regarding the legal standing of a third party attempting to seek relief on behalf of a convicted individual. Following these objections, the Registrar's Office rejected the filing and instructed that the plea be re-submitted with the necessary corrections.
Gandapur had sought for the release of Khan, citing ill health and uncertainty amid high tensions with India.
Imran Khan was detained by authorities in 2023 in a pounds 190 million corruption case and is also facing pending trials under the Anti-Terrorism Act related to the May 9, 2023 protests.
The petition termed these cases as being “politically motivated” and lacking credible evidence.
The plea also cited Khan’s deteriorating health and references the Good Conduct Prisoners’ Probational Release Act, 1926, as well as international precedents — including Nelson Mandela’s release — as grounds for parole.
It drew parallels to the 2020 Supreme Court order that allowed parole for prisoners during the Covid-19 pandemic.
