Mizoram moves closer to setting up State Human Rights Commission after court intervention

Aizawl, Mar 19 (UNI) The long-pending establishment of the Mizoram State Human Rights Commission (MSHRC) is finally gathering momentum, with Chief Minister Lalduhoma informing the Assembly on Wednesday that the government has issued the necessary notifications and created 16 posts for the commission.
Responding to a query raised by Mizo National Front (MNF) legislator K. Laldingliana, the chief minister provided a detailed update on the commission’s progress. According to Lalduhoma, the official notification for the formation of the MSHRC was issued on October 11 last year. This was followed by another government notification on November 14 to constitute a search and selection committee tasked with appointing the chairperson and members of the commission.
The chief minister pointed out that while there have been no major roadblocks, the process of appointing officials, creating a new head of account to manage expenses and salaries, as well as identifying office premises and residential accommodations, are time-consuming steps.
Lalduhoma further revealed that discussions have also been initiated regarding the possibility of forming a joint commission with a neighbouring state, although no final decision has been taken.
The drive to set up the MSHRC gained urgency following the intervention of the Gauhati High Court, which expressed strong disapproval over the state's prolonged delay.
On September 6 last year, the division bench of Chief Justice Vijay Bishnoi and Justice Michael Zothankhuma, during a sitting in Aizawl, issued a stern ultimatum to the state government, granting it a final two-month window to establish the commission. The court warned of possible penalties if the state government continued to ignore the deadline.
The High Court’s order came in response to a public interest litigation (PIL) filed by the Zofa Welfare Organization (ZWO), led by its president Rev. Robawia, in 2021.
The PIL demanded that the state government comply with the Protection of Human Rights Act, 1993 and promptly establish the commission. The court observed that despite multiple assurances from the state and the sanctioning of posts, progress was limited to paperwork and announcements.
Significantly, the court referred to the 2015 Supreme Court directive in the Dilip Kumar Basu case, which had instructed all states, including Mizoram, to set up their respective human rights commissions. The Gauhati High Court took note of the state government’s failure to act for years after that directive and made it clear that such negligence could not continue indefinitely.
While the process has finally been set in motion, the state government’s efforts are a clear response to judicial pressure rather than voluntary initiative. The completion of formal appointments, staffing, and securing the necessary infrastructure will determine how soon the MSHRC becomes functional. UNI ZS XC SSP
