State cabinet approves ex-gratia for Group C and D staff dismissed in SSC jobs scam verdict

Kolkata, May 14 (UNI): The West Bengal cabinet on Wednesday approved an ex-gratia payment of Rs 25000 and Rs 20000 respectively for Group C and Group D staff from the 2016 School Service Commission panel who lost their jobs following a Supreme Court order earlier this month in connection with the cash-for-jobs scam.

Chief minister Mamata Banerjee on April 26 had announced the ex-gratia payment to be given to the families of the Group C and Group D staff for as long as the court case remains pending and on Wednesday it was approved by the state government.

However, to ensure the financial assistance withstands legal scrutiny and is not challenged in court, the compensation will be provided under the ‘West Bengal Livelihood and Social Security Interim Scheme’, introduced by the state’s Labour Department.

Speaking on the occasion, the chief minister said, “There are some people who go to the court to file a PIL (Public Interest Litigation) at the drop of the hat. They cannot give jobs to anyone but yet they’re quick to try and take it away from others.”

On April 3, a Supreme Court division bench headed by Chief Justice of India Sanjiv Khanna and Justice Sanjay Kumar dismissed 25,753 teaching and non-teaching staff from state-run and state-aided schools, upholding a previous Calcutta High Court order. The Court found that the "entire selection process was vitiated" and marked by "large-scale manipulation and fraud."

Two weeks later, the Supreme Court allowed teachers of Classes IX to XII to return to classrooms but directed the state government to restart the recruitment process and complete it by December 31, with no concessions made for Group C and Group D staff.

“We will only grant an extension to teachers, not Group IV candidates,” CJI Khanna had said citing the high number of confirmed tainted candidates among the non-teaching staff.

Mamata Banerjee also assured the teachers and non-teaching staff protesting on the streets that the state government would seek a review of the Supreme Court order. Although she had earlier rebuked the protesters for demanding separate lists of "tainted" and "untainted" candidates, she maintained that no such evidence-backed list had been provided to the state.

“We will file the review petition by the first week of May. Legal advice is being taken. We will also try to ensure they are not made to sit for fresh tests. If the Supreme Court rejects the petition entirely, we will explore alternate legal routes to protect the jobs without violating the law,” Mamata said. UNI XC SSP
