CCPA advises e-commerce platforms to eliminate dark patterns

New Delhi, June 7 (UNI) The Central Consumer Protection Authority (CCPA) has issued an advisory to all e-commerce platforms, urging them to take immediate and effective steps to eliminate deceptive and unfair trade practices commonly known as dark patterns.

In a move aimed at strengthening consumer rights in the digital ecosystem, the CCPA has directed platforms to conduct self-audits within three months to identify such practices and take corrective measures. Based on these audits, platforms are encouraged to submit self-declarations affirming that their digital interfaces are free from dark patterns, thereby promoting transparency and building consumer trust.

The advisory comes amid growing concern over manipulative online design tactics that mislead or coerce consumers into making unintended choices. The CCPA has already issued notices to some platforms found violating the Guidelines for Prevention and Regulation of Dark Patterns, notified in 2023 by the Department of Consumer Affairs.

The 2023 guidelines identified and classified 13 dark patterns, including False Urgency, Basket Sneaking, Confirm Shaming, Subscription Trap, Drip Pricing, Disguised Advertisements, and Trick Wording, among others. These patterns are often embedded into online interfaces to manipulate user behaviour and restrict free and informed choice.

To tackle this issue holistically, a Joint Working Group (JWG) has been constituted comprising representatives from various ministries, regulators, voluntary consumer organisations and National Law Universities (NLUs).

The JWG has been tasked with identifying dark pattern violations, sharing findings with the Department of Consumer Affairs, and suggesting public awareness campaigns to educate consumers.

The CCPA reiterated that it is closely monitoring digital platforms and warned that any continued violation of the guidelines would invite regulatory action. The authority’s latest initiative is part of the government's broader effort to ensure a fair, transparent, and consumer-friendly digital marketplace in India.
