Cornell University alleged sexual assault case reopened after two years as Jane Doe alleges gang rape

New York, Oct 2 (UNI) A sexual-assault case involving a former Cornell University student has returned to the spotlight after prosecutors reopened their investigation into allegations that seven men assaulted her at a fraternity house in October 2024.
The woman, identified in court documents as Jane Doe, was 20 at the time. She filed a civil lawsuit against Cornell, the fraternity and the men on September 16, alleging that she was drugged, sexually assaulted and inadequately protected by the university.
According to the BBC, Doe went to the Chi Phi fraternity house in Ithaca on the night of October 19, 2024, after drinking, to meet a male friend. She initially had a sexual encounter with two men she knew, which she later told investigators she had regarded as consensual. She alleges that more men then entered the room, her intoxication increased and she became unable to consent or stop what was happening.
In her original interview with Cornell investigators, Doe said she had initially been "pretty OK" with the encounter. But as more men arrived, she became increasingly uncomfortable and intoxicated. She also said she felt pressured to take ketamine and eventually believed she could no longer make decisions for herself.
Doe did not immediately describe the incident as rape. Records obtained by The New York Times show that she struggled to understand what had happened and was also dealing with rumours circulating among students. The newspaper reported that an online comment describing the encounter as a "gang rape" was a turning point in how she understood the incident. She later told investigators, "I can say with 100 per cent confidence I was raped."
Messages exchanged after the incident also form part of the evidence. One of the men later accused by Doe sent her an apology for "how things went down", saying his memory was "kinda fuzzy" and that he and another man had been too intoxicated to stop the situation before it "got way out of hand".
Doe initially replied that none of the sexual activity was illegal and that she had enjoyed being with him and another man. The Times reported that her account changed as she processed what had happened, and she eventually told one of the men that most of the encounter had not been consensual.
She reported the incident to Cornell University Police on November 8, 2024, and was interviewed several days later. Her interview with police and a university Title IX investigator ran to roughly 120 pages, according to The New York Times. Cornell police later submitted a six-page summary to the district attorney.
District Attorney Matthew Van Houten said prosecutors had initially concluded that the evidence did not meet the legal threshold for criminal charges. The Times, however, found that the police summary omitted parts of Doe's longer account, including details about her state of mind, her previous experience as a sexual-assault survivor and how she came to understand the encounter.
The newspaper obtained more than 1,000 pages of records from Cornell's internal investigation, including interviews with six of the seven men accused, 20 other witnesses, and messages and emails. The men generally denied assaulting Doe, describing the sexual activity as consensual. Several told investigators that she had initiated sexual activity.
Cornell said its police department investigated the complaint and that its Title IX process resulted in disciplinary action, including suspensions and expulsions. The university has disputed Doe's claims that it failed to investigate adequately or punish those involved. The Chi Phi chapter was suspended and later closed in 2024, and remains barred from campus. The national fraternity has also said it removed the accused members.
Cornell has agreed to an independent investigation into its handling of the case.
Van Houten announced that prosecutors had reopened the criminal inquiry after Doe's lawsuit brought renewed attention to the allegations and additional information became available. He said her original 2024 statement did not allege that she had been drugged against her will or gang raped, and that parts of it described the drug use and sexual activity as voluntary and consensual.
The Times' account of the full interview, however, included further details about Doe's intoxication, discomfort and changing understanding of the encounter. Prosecutors will now examine the additional evidence and decide whether the case should be presented to a grand jury.
The criminal investigation, civil lawsuit and university review are ongoing. The allegations remain contested, and the reopening of the investigation does not establish criminal liability.
