Court Summons Pasted at YouTuber Dhruv Rathee's Gurugram Home in BJP IT Cell Defamation Case

Chandigarh, Oct 15 (UNI) A Delhi court's summons in a criminal defamation case against YouTuber Dhruv Rathee has been affixed to the gate of his residence in Gurugram after repeated attempts to serve him, according to the complainant's lawyer, ahead of a protest planned in the national capital on October 16.
The case, pending before the Saket court since 2018, was filed by Vikas Sankrityayan, also known as Vikas Pandey, who identifies himself as a member of the Bharatiya Janata Party's IT cell. It concerns allegations made in Rathee's YouTube video titled BJP IT Cell Part 2.
The court had first issued summons in July 2019, but the complainant's side said efforts to serve Rathee had remained unsuccessful for several years.
According to the complainant, the court was recently informed that Rathee was visiting India and was believed to be in the Delhi-National Capital Region. The court subsequently permitted the complainant to accompany the official responsible for serving the summons.
The summons was pasted at Rathee's residence in Kendriya Vihar, Gurugram, after attempts at personal service failed, the complainant's side said. The matter is scheduled for its next hearing on October 17.
Advocate Sushant Kumar, representing the complainant, alleged that Rathee had declined to accept the court notice when contacted by telephone. The complainant's side also told the court that Rathee had been ordinarily residing in Austria for several years, making personal service difficult.
The criminal defamation complaint stems from a video published by Rathee in 2018 concerning the BJP's IT cell and its alleged activities.
Pandey alleged that the video contained "false and fabricated" accusations that damaged his personal, social and professional reputation.
The video included allegations concerning an attempted payment to a person identified as Mahavir Prasad and a purported offer of Rs 50 lakh to discredit Rathee. These allegations are disputed and form part of the underlying controversy.
Pandey has denied wrongdoing and maintained that the accusations against him were baseless.
The development comes ahead of an October 16 gathering announced by a group calling itself the Cockroach Janata Party (CJP) at Central Park in Delhi. Rathee has shared a social media post about the proposed flag-hoisting event, although his attendance has not been independently confirmed.
In a video released on October 11, Rathee alleged that he had been taken to a police station by unidentified men on October 10, kept at a Crime Branch office, and released late that night. Those allegations could not be independently verified.
Pandey also claimed that former Delhi Chief Minister Arvind Kejriwal had previously apologised in connection with the circulation of Rathee's video. That claim was not independently verified from court records.
The affixing of the summons is a procedural step in the pending criminal case and does not establish Rathee's guilt.
Rathee's response to the latest reported service of summons was not available in the information reviewed.
