CPI(ML) demands judicial probe into custodial death of Dalit farmer in Shravasti

Lucknow, Sep 24 (UNI) The CPI(ML) on Thursday demanded a high-level judicial inquiry into the death of Dalit farmer Kamlesh in police custody in the Gilaula area of Shravasti and sought the filing of a murder case against the police personnel and other officials found responsible.
The party alleged that the incident raises serious questions about the safety of Dalits and other vulnerable sections in police stations and in police custody, despite the state government's claims regarding law and order.
CPI(ML) State Secretary Sudhakar Yadav said the Shravasti incident should not be dismissed as a case of mere police or administrative negligence. He said Kamlesh's family has alleged that he was tortured in custody and assaulted by the opposing party while under police protection.
According to the administration, a police-revenue team was taking Kamlesh and some others to the police station in connection with a land dispute when he allegedly jumped from the police vehicle and sustained injuries, later succumbing to them.
Yadav said the conflicting accounts made an impartial judicial inquiry necessary to establish the facts.
“If Kamlesh was subjected to custodial assault, third-degree torture or inhuman treatment, as alleged by his family, it would amount to a serious criminal offence,” he said, adding that suspension or departmental action alone would not be sufficient if criminal wrongdoing is established.
The CPI(ML) leader demanded that a murder case be registered against all police personnel found responsible, including the station in-charge, and that those accused be arrested in accordance with law. He also called for officials connected with the incident to be kept away from the investigation to prevent any possibility of interference with evidence or witnesses.
Yadav also sought an impartial inquiry into the role of the Revenue Department in the land dispute. The administration has prima facie held the Revenue Inspector and Lekhpal responsible for negligence and suspended them. He said criminal action should also follow if an investigation establishes their complicity, bias or improper protection of either party.
Sudhakar Yadav stated that this incident is not an isolated one. Earlier, 22-year-old Dalit youth Arjun Gautam died under suspicious circumstances at the Patti police station in Pratapgarh. According to the police, he was found hanging in the police station's toilet, while the family alleges that he was beaten and murdered during police interrogation. The station in-charge and a sub-inspector have been suspended, and a case has been filed based on the family's complaint.
He stated that the deaths of two Dalit youths in police custody within a single week raise serious questions. The Yogi government should explain who is responsible for the safety of citizens in police custody. The mere formality of suspension and departmental inquiry will not stop the series of custodial deaths. An independent and timely judicial inquiry is essential to hold guilty police officers accountable and provide justice to the families of the victims.
The CPI(ML) state secretary stated that the case of Vinod Kumar Sahni's murder in Parsapur, Gonda, has not yet been completely resolved. Vinod Sahni, who was seriously injured in the attack on September 9th, died while undergoing treatment at KGMU, Lucknow, and questions have been raised about the role of the police and the security arrangements in this case.
He stated that the rule of law for the vulnerable and marginalized in the state will only be established when the police and administration are accountable to the law. Instead of giving the police free rein, the government should conduct an independent investigation into every custodial death, arrest the culprits, and ensure justice for the families of the victims.
The CPI(ML) demanded an immediate high-level judicial inquiry into Kamlesh's death, a probe into the circumstances surrounding his custody and injuries, including the role of the police vehicle and officials involved, and an investigation into the roles of police and revenue officials in the underlying land dispute.
The party also sought adequate compensation and security for Kamlesh's family and called for a clear accountability mechanism to prevent custodial deaths in the state.
