DC Srinagar appears before High Court in preventive detention case

Srinagar, Oct 23 (UNI) Deputy Commissioner Srinagar appeared before the High Court of Jammu and Kashmir and Ladakh in connection with a preventive detention order against Zubair Amin Bangroo, after the court raised serious questions over the alleged mechanical formulation of the order.
Justice Wasim Sadiq Nargal, while hearing the habeas corpus petition on October 22, recorded the presence of the Deputy Commissioner pursuant to its earlier order dated October 15.
The court concluded arguments and directed counsel for the parties to furnish brief synopses along with copies of the judgments they intend to rely upon at the next hearing.
Senior Additional Advocate General Mohsin-ul-Showkat Qadiri was also directed to produce the detention record on the next date.
The matter has been listed in the supplementary cause list on October 29 for the limited purpose of filing the synopses and judgments.
The High court had on October 15, raised serious concerns over the alleged mechanical formulation of the detention order against Bangroo, questioning whether the detaining authority had independently applied its mind to the material supplied by the police.
In its earlier observations, Justice Nargal had flagged the use of the expression “aforementioned terrorists” in the grounds of detention despite no preceding identification of any terrorist, prima facie suggesting that portions of the grounds may have been lifted mechanically from the police dossier.
The court had also expressed concern over the alleged vagueness of the detention grounds and emphasised that the gravity of allegations cannot substitute the requirement of relevant material and independent application of mind.
