New Delhi, May 22 (UNI) A court here on Thursday issued summons to the complainant in a case filed against Bharatiya Janata Party (BJP) Member of Parliament (MP) Yogender Chandolia who allegedly assaulted an on duty Traffic Police Official in 2020.
After hearing both sides, Additional Chief Judicial Magistrate (ACJM) Neha Mittal said, "Matter is listed for Prosecution Evidence (PE). However, summons have not been issued to the witness by the Ahlmad. The Ahlmad is directed to be careful in future."
"Complainant be summoned for evidence on July three, 2025 for PE," the court said.
The court had earlier said, "In view of the discussion, accused Yogender Chandolia is discharged under Section 186 of Indian Penal Code and prima facie case for offences punishable under Sections 341, 353, 356 and 34 of Indian Penal Code is made out against the accused."
In this matter, a call was received on October seven, 2020 at Prasad Nagar Police Station regarding the blocking of a crane by a group of people, upon which ASI Pavinder Kumar along with Constable Sunil had reached the spot.
Complainant HC Raj Kumar in a written complaint on October eight, 2020, stated that on October seven, 2020 at around 4:30 pm while he was on crane duty near Shiv Mandir, Tank Road, he pointed towards one Scooty which was improperly parked.
Following which, the accused started shouting and asked why he is not lifting other cars, which are also improperly parked.
The accused then blocked the way of the crane and used abusive language against the complainant. The accused incited people who gathered at the spot and kept on misbehaving with complainant despite repeated efforts to pacify him.
It is further alleged in the complaint that the complainant started recording the incident on his mobile phone upon which the accused tried to snatch his phone and also pulled down the complainant when he was trying to board the crane.
It is further alleged that the complainant handed over his mobile phone to his crane operator Beera but some unknown accomplice of the accused snatched the mobile phone from Beera.
Thereafter, the accused kept the keys of the crane and the mobile phone of the complainant with himself, upon which he dialled 100 number and TI was also intimated.
The FIR was registered on October eight, 2020 under Sections 186 (obstructing public servant in the discharge of his public functions), 341 (wrongful restraint) and 353 (assault to deter a public servant from discharge of their duty) of Indian Penal Code (IPC) against Chandolia.
After conclusion of investigation, the charge-sheet was filed in the court.
