Gudiya rape case: Himachal HC judge hearing appeal of convict recuses

Shimla, May 23 (UNI) A member of a division bench of Himachal Pradesh High court hearing the criminal appeal filed by convicted Nilu in the Gudiya rape case on May 19 has decided to recuse from matter, as per an order uploaded on the high court website.
The division bench of justice Ajay Mohan Goel and Justice Bipin Chandra Negi was scheduled to hear an appeal filed against convicted Nillu on May 19, but Justice Goel decided to recuse.
"A one-page order states that the matter is likely to be assigned before another bench, in which one of us (Justice Ajay Mohan Goel) is not a member, at the pleasure of the Chief Justice," the order stated.
A short order uploaded on Himachal Pradesh High Court website states that in the matter of Anil Kumar Nillu alias Kamlesh versus Central Bureau of Investigation would be listed before another bench.
During the hearing, counsel for the appellant Jeevesh Sharma and standing counsel for the respondent CBI Janesh Mahajan were present in the court.
A local court on June 17, 2021 sentenced a 28-year-old man to life imprisonment for raping and murdering a 16-year-old schoolgirl in a forest in Shimla's Kotkhai area in 2017. The court also imposed a penalty of Rs 10,000 on convict Anil Kumar alias Nillu, a woodcutter.
Special judge Rajeev Bhardwaj held the accused guilty after three long trials in the matter.
The victim had gone missing while walking home from school on July 4, 2017, and was later found dead in a ditch in a forested area in Kotkhai. The heinous crime, later named as the Gudiya case to protect the victim's identity, had triggered outrage across Himachal Pradesh.
The case saw dramatic twists, including the custodial death of a man earlier suspected of having committed the crime and the arrest of a senior police officer.
The CBI then took charge of the case and arrested Anil three years ago.
Special Judge Bhardwaj had on April 28 held Anil guilty under Sections 376 (2)(i), 376 (A), and 302 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences (POCSO) Act.
