IYC files complaint against Hosabale’s Preamble remark

Bengaluru, June 29 (UNI) A formal police complaint has been filed against Rashtriya Swayamsevak Sangh (RSS) General Secretary Dattatreya Hosabale by the Karnataka unit of the Indian Youth Congress (IYC) Legal Cell, following his contentious remarks on the Constitution’s Preamble.
The complaint, lodged at Seshadripuram Police Station today, alleges that Hosabale’s recent call to “reconsider and remove” the terms “socialist” and “secular” from the Preamble is an “attack on the constitutional ethos” and “incitement against the nation’s founding values”.
Hosabale made these remarks on June 26, while addressing an event marking the 50th anniversary of the Emergency. He claimed that the terms were not part of Dr B R Ambedkar’s original Constitution and were forcibly inserted during the Emergency through the 42nd Constitutional Amendment Act of 1976.
“These words were inserted when Parliament and courts were not functioning. A serious national debate is needed on whether these terms are in sync with India’s cultural and democratic ethos,” Hosabale had said.
The IYC complaint demanded legal action, accusing him of making “unconstitutional, inflammatory, and divisive” comments.
Police have acknowledged receipt of the complaint and said the matter is under legal review.
The remark has triggered a political storm, with opposition parties and civil society organisations condemning what they termed as a “direct assault on the Constitution”.
Congress leader Jairam Ramesh called it a “blatant move to undermine secular democracy” and said the RSS wants to replace the Constitution with Manusmriti.
Rahul Gandhi said, “The mask has come off. This is not a debate, it is an attempt to dismantle the Republic.”
In Kerala, Chief Minister Pinarayi Vijayan termed the RSS push as a “communal agenda” and a “direct threat to India’s democratic soul.”
Karnataka CM Siddaramaiah said: “We will not allow any tampering with the Constitution. These terms are integral to our national identity.”
Meanwhile, Assam CM Himanta Biswa Sarma backed the RSS leader, calling the inclusion of “secular” and “socialist” a mistake rooted in “Western ideologies”.
In its defence, the RSS-affiliated weekly 'Organiser' said the statement was about “restoring the original spirit” of the Constitution and not about subverting democracy. It argued that the inclusion of the terms during Emergency was “undemocratic” and warrants honest public discourse.
The terms “socialist” and “secular” were officially included in the Preamble through the 42nd Amendment in 1976 during the Emergency imposed by then Prime Minister Indira Gandhi.
However, the Supreme Court in 2020 upheld their inclusion as essential components of the Constitution’s basic structure, ruling out arbitrary removal without a constitutional amendment passed by both houses of Parliament and upheld by the judiciary.
The controversy is expected to escalate politically and legally in the days to come. While the RSS and BJP leaders push for a national conversation on constitutional values, opposition parties have vowed to defend what they call the “soul of the Republic”.
