J&K High Court orders passport revival of MBBS student impounded over father’s 1997 case

Srinagar, Oct 8 (UNI) The Jammu and Kashmir and Ladakh High Court has directed authorities to revive the passport of an MBBS student pursuing her studies in Iran after her passport was impounded in connection with a case registered against her father in 1997.
A Division Bench comprising Chief Justice Dr Pushpendra Singh Bhati and Justice Wasim Sadiq Nargal passed the directions on October 5 while disposing of an appeal filed by a female student pursuing MBBS at Tehran University of Medical Sciences, Kish Campus, Iran.
The appellant had challenged the impounding of her passport following show-cause notices issued on March 27 and April 9, 2026, which culminated in an order dated May 4, 2026.
During the hearing, her counsel submitted that she had already completed two years of the MBBS course on the strength of the passport and admission granted to her and that the university was recognised by the National Medical Commission.
The court had called for a report from the State in a sealed cover. According to the order, the report contained certain aspersions against the appellant's father in connection with a case registered in 1997 and expressed apprehension that the appellant could join anti-India forces, thereby jeopardising the security and sovereignty of the country.
The court noted that the respondents were unable to pinpoint the basis for such apprehension, particularly as the case referred to was from 1997 while the appellant herself was born in 2005.
The Bench, while stating that it had the highest respect and concern for the security of the country, said the present intervention was being made in view of the peculiar facts and circumstances of the case.
“..the fact that the appellant has completed half of her MBBS course and is required to complete the remaining half, we dispose of the present appeal by directing that the passport of the appellant shall be revived for the remaining period required for completion of her MBBS course,” the Court order read.
However, the court allowed the respondents to conduct a fresh security audit before reviving the passport if there was any material on record apart from what had been placed before the court in the source report. The authorities were also given liberty to impose necessary conditions based on their expert assessment, which the appellant would be required to comply with before the passport is revived.
The court clarified that the order was being passed in the peculiar circumstances of the case and would not be treated as a precedent.
