Jharkhand: HC declines to quash PMLA case after coal case acquittal

Ranchi, Sep 16 (UNI) The Jharkhand High Court has held that acquittal in a predicate offence does not automatically end proceedings under the Prevention of Money Laundering Act (PMLA) if the acquittal is still open to appeal.
Justice Sujit Narayan Prasad, hearing a petition filed by Amar Mandal, declined to quash the Enforcement Directorate's ECIR registered under Sections 3 and 4 of the PMLA.
Mandal had sought quashing of the Enforcement Case Information Report after a Godda court acquitted him on February 10, 2026, in cases relating to alleged illegal transportation of coal.
The High Court said PMLA proceedings cannot continue if a person is completely and finally discharged, acquitted or the scheduled offence is quashed. However, it found that Mandal's acquittal had not attained finality as it could still be challenged before the competent appellate court.
The court also noted that the trial court's order related to alleged illegal transportation of coal by a truck and had not finally adjudicated on the recovery of Rs 85 lakh in cash, 134 original property documents and alleged bank transactions of around Rs 8.94 crore.
The court said the acquittal could not, at this stage, be used as a blanket shield against PMLA proceedings concerning these aspects.
Proceedings relating to the seized properties were pending before the PMLA Adjudicating Authority in New Delhi. The petitioner had also filed a reply to the show-cause notice issued under Section 8(1) of the PMLA.
The High Court declined to quash the ECIR, observing that it is an internal ED document used for initiating and pursuing an investigation and cannot be equated with a regular FIR.
