Karnataka HC directs constitution of district panels to tackle illegal immigration

Bengaluru, Oct 23 (UNI) The Karnataka High Court has directed the state government to constitute and operationalise district-level committees to deal with cases of illegal immigration within three months, strictly in accordance with the prescribed standard operating procedure (SOP).
Justice M Nagaprasanna, while granting relief to Bengaluru-based doctor T Nagendrappa in two criminal cases, directed the government to submit a comprehensive compliance report detailing the constitution, composition and operational status of the committees before the court registry.
The direction came while the court was hearing petitions filed by Nagendrappa, who had challenged two criminal cases registered against him by Bellandur and Varthur police and sought compensation in a separate petition over his arrest.
According to the petitioner, he had alerted the police in July after noticing alleged Bangladeshi nationals staying behind a government school at Kodathi village on Sarjapur Main Road. Subsequently, two criminal cases were registered against him on allegations of threatening and assaulting the immigrants.
The court noted that Mohammed Saidul Islam, who had lodged a complaint against the petitioner, had been detained for unauthorised entry into and stay in India, as established by a restriction order issued by the Foreigners Regional Registration Office (FRRO).
Observing that the sequence of events and official records raised serious concerns about the manner in which the criminal process had been initiated, the court quashed the proceedings against Nagendrappa in both cases.
The judge observed that when official records, the chronology of events and surrounding circumstances indicated that a prosecution was allegedly driven by vengeance, a constitutional court could not remain a silent spectator and allow criminal proceedings themselves to become a form of punishment.
Addressing the broader issue, Justice Nagaprasanna observed that illegal immigration was not merely a violation of laws governing entry into and residence within the country, but also posed challenges to national sovereignty, border integrity and internal security.
Unregulated and undocumented cross-border movement, if left unchecked, could create vulnerabilities in governance and facilitate identity fraud, human trafficking, organised criminal activities and other unlawful practices, the court noted.
It could also place unforeseen pressure on public infrastructure, welfare administration and the fair distribution of public resources, the judge added.
The direction to establish district-level committees within three months is aimed at ensuring a structured institutional mechanism to address cases of illegal immigration in accordance with the prescribed procedure.
