Maha: Govt halts registration of documents for unauthorized buildings

Nashik, Oct 13 (UNI) In a major move to curb property fraud and unauthorized construction, the Maharashtra government has decided to stop the registration of property documents related to unauthorized buildings and flats that violate approved construction norms.
Following directions from Chief Minister Devendra Fadnavis, Revenue Minister Chandrashekhar Bawankule has announced strict measures to prevent the illegal sale of flats and protect homebuyers from financial losses. The Revenue Department has issued a circular directing all Sub-Registrars across the state to strictly comply with the new guidelines.
The government’s decision comes amid growing complaints of unauthorized residential construction, buildings erected without the necessary permissions, projects lacking mandatory MahaRERA registration, and the sale of flats constructed beyond approved limits. Such cases have been reported in areas including the Mumbai Metropolitan Region (MMR), Thane, Pune, Pimpri-Chinchwad, Haveli, Mulshi and Nagpur.
For the first sale of flats in projects requiring registration under the MahaRERA Act, developers will have to submit the registration certificate or occupancy certificate, along with the approved building plan.
For projects exempt from MahaRERA registration, documents such as the commencement certificate (CC) issued by the competent authority, approved building plan, zoning certificate and measurement plan will be mandatory.
Sub-Registrars will not be permitted to register property documents if the area of a flat mentioned in the documents exceeds the area approved in the sanctioned building plan.
Flats in buildings that violate the Unified Development Control and Promotion Regulations (UDCPR), Development Plan (DP) or Regional Plan provisions will not be permitted to be sold directly unless the buildings are regularized in accordance with applicable laws.
Buildings that cannot be regularized will not be granted legal status and may face demolition proceedings.
The government has warned that departmental inquiries will be initiated against Sub-Registrars who knowingly register documents related to unauthorized constructions in violation of the new directives.
The measures aim to prevent homebuyers from investing their lifetime savings in illegal properties and suffering substantial financial losses after discovering that their homes lack legal authorization.
Minister Bawankule said protecting ordinary citizens from property-related fraud was the government's primary responsibility. He added that the decision had been taken to put a permanent stop to such malpractice and safeguard the interests of homebuyers.
