Pakistani man summoned over second marriage to Indian Sikh pilgrim without required permission

Chandigarh, Oct 17 (UNI) A Lahore court has issued a notice to Nasir Hussain, the Pakistani husband of Indian woman Sarabjit Kaur, over allegations that he contracted a second marriage without obtaining the permission required under Pakistan's Muslim family laws, according to the lawyer representing his first wife.
The court has directed Hussain to appear on November 10, 2026, after taking up a private complaint filed by Saima Nasir, her lawyer, Ali Changezi Sandhu, said.
Saima filed the complaint on October 15, seeking legal action against Hussain for allegedly marrying Kaur without securing the necessary approval.
Sandhu said the complaint invoked Section 6 of the Muslim Family Laws Ordinance, 1961, which requires a married Muslim man to obtain prior written permission from the Arbitration Council before contracting another marriage.
Under the law as amended in Pakistan's Punjab province in 2015, a person convicted of violating the provision faces imprisonment of up to one year and a fine of 500,000 Pakistani rupees.
Saima alleged that Hussain forced her and their four minor children out of their home after marrying Kaur. She has also sought maintenance for the children and residential accommodation.
Saima and her brother, Muhammad Nadeem, have recorded statements supporting the complaint, according to her lawyer.
The proceedings mark another development in the legal dispute surrounding Kaur, a resident of Kapurthala district in India's Punjab state, who travelled to Pakistan in November 2025 as part of a Sikh pilgrimage.
Kaur entered Pakistan on November 4 with a group of 1,932 Sikh pilgrims visiting religious shrines to mark the birth anniversary of Guru Nanak Dev.
She did not return to India with the group on November 13, when her visa reportedly expired.
Kaur subsequently converted to Islam, adopted the name Noor Fatima and married Hussain, a resident of Sheikhupura district, according to accounts of the case.
The marriage came to public attention after documents relating to the ceremony circulated on social media.
Kaur and Hussain later approached the Lahore High Court seeking protection against alleged police harassment.
Her Indian husband, Karnail Singh, subsequently challenged the marriage, contending that Kaur had not legally dissolved their existing marriage before marrying Hussain.
In proceedings before the Lahore High Court, Karnail also sought Kaur's deportation to India and legal action over allegations surrounding her conversion and marriage.
Those allegations remain contested.
Separately, Saima initiated maintenance proceedings in September, seeking 80,000 Pakistani rupees a month for herself and her four minor children.
She also moved the Lahore High Court alleging unlawful occupation of her family property.
The latest complaint against Hussain concerns the legal requirements governing a second marriage and is separate from the proceedings involving Kaur's immigration status and the validity of her marriage.
The Lahore court is scheduled to take up Saima's complaint on November 10, according to her lawyer.
