Bombay HC strikes down MbPA’s retrospective rent hikes, grants major relief to over 200 traders and tenants

Mumbai, Sep 7 (UNI) Over 200 traders, tenants, and families operating on Mumbai Port Authority (MbPA) land can finally breathe a sigh of relief following a pivotal legal breakthrough that shields them from financial ruin.
In a landmark judgment, a Bombay High Court division bench of Justices Bharati Dangre and Manjusha Deshpande decisively struck down the MbPA's controversial retrospective rent hikes, invalidating gazette notifications and recovery notices that slapped tenants with astronomical differential lease arrears dating from October 2012 to September 2022.
The court ruled that the historical compromise proposal, backed by the Supreme Court in the landmark Jamshed Hormusji Wadia case, legally governs these properties with an annual 4 per cent increase up to March 31, 2024. The bench sternly rebuked the port authority, declaring that statutory public bodies cannot function like private landlords or indulge in "profiteering and rack-renting" through internal rate revisions tied to hypothetical, highest-market land values.
