Petition filed against CEC Gyanesh Kumar in Kolhapur Bench of Bombay HC

Kolhapur, Sep 24 (UNI) A petition filed against Chief Election Commissioner Gyanesh Kumar in the Kolhapur Bench of the Bombay High Court has sought to reinstate the names of voters who were deleted from the electoral roll, along with stopping the SIR process in the state.
Prathamesh Gopal Gavankar, Gaurav Suryakant Nakhrekar, Aadesh Shashikant Bhatkar, and Smitali Nilesh Narvekar, assisted by Asim Sarode, have filed a petition in the High Court in the Kolhapur Bench of the Bombay High Court, raising questions over certain decisions and administrative procedures taken under the leadership of Chief Election Commissioner Gyanesh Kumar.
The Central Election Commission, New Delhi, Chief Election Commissioner Gyanesh Kumar, Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi, and the State Election Commission have been made respondents in the petition.
Notably, the petition cites a report published by the Indian Express daily that two Election Commissioners of the Election Commission — Sukhbir Singh Sandhu and Vivek Joshi — had raised objections to various decisions and procedures at least 14 times.
According to the petitioners, these objections relate to voter registration, deletion and restoration of voters' names, database of voter lists, working procedures of Electoral Registration Officers and related software processes.
Against this backdrop, the legal question raised in the petition is whether the Election Commission has acted collectively as per Section 18 of the Chief Election Commissioner and Other Election Commissioners Act, 2023.
The petition also objects to the changes made in Form-6 in July 2026.
The petition also states that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi have also raised objections to the functioning of the ECINet system.
