Odisha woman Judge comes downstairs to examine accused unable to climb stairs

Bhubaneswar, Oct 31 (UNI) A woman judicial officer in Odisha’s Jagatsinghpur district stepped out of her courtroom to record the statement of an accused person with mobility impairment who could not access the court on the upper floor of the three-storey building.
The accused, 50-year-old Bishnu Sahu of Singipur village under Jagatsinghpur police limits, and his wife are facing criminal cases registered at the police station in 2018. The cases have been pending trial for the past eight years. Sahu, who has paralysis and other serious health complications, has been unable to attend court regularly.
Under Section 351 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), a court must personally examine an accused during an inquiry or trial to allow them to explain the circumstances appearing against them.
When Sahu arrived at court on Thursday but was unable to climb the stairs, his counsel, Birabar Barik, apprised Judicial Magistrate Second Class (JMSC) Sriyanka Dash of his health condition and mobility-related difficulties. The judge decided to record the statements of both Sahu and his wife on the court premises rather than require them to appear in the courtroom upstairs.
Dash came down from the courtroom and examined the two accused in the presence of their counsel and Assistant Public Prosecutor Prahallad Nayak.UNI MK AAB
