President amends Inter-State Council Order; Governors, LGs to attend meetings when President’s Rule provisions are in force

New Delhi, Sep 18 (UNI) President Droupadi Murmu has amended the Inter-State Council Order, 1990, providing for Governors or Lieutenant Governors to be invited to meetings of the Council when President’s Rule or specified corresponding constitutional or statutory provisions are in force in a state or the union Territories of Delhi, Puducherry and Jammu and Kashmir.
The Inter-State Council (Amendment) Order, 2026, issued in exercise of the powers conferred on the President under Article 263 of the Constitution, has come into force immediately, according to a Ministry of Home Affairs notification published in the Gazette of India.
The notification, S.O. 5143(E), is dated September 9, 2026, and was published in the Gazette issued on September 18.
Under the amended provision, where a proclamation issued by the President under Article 356 is in force in relation to any state, the Governor of that state shall be invited to attend meetings of the Inter-State Council.
The amendment makes similar provisions for three union Territories under their respective constitutional or statutory arrangements.
In the case of the National Capital Territory of Delhi, if an order issued by the President under Article 239AB of the Constitution is in force, the Lieutenant Governor of the NCT shall be invited to attend Council meetings.
For Puducherry, its Lieutenant Governor shall be invited to the meetings when an order issued by the President under Section 51 of the Government of union Territories Act, 1963, is in force.
Similarly, where a proclamation under Section 73 of the Jammu and Kashmir Reorganisation Act, 2019, is in force in the union Territory of Jammu and Kashmir, its Lieutenant Governor shall be invited to attend meetings of the Council.
The amendment substitutes the existing proviso to Clause 2 of the Inter-State Council Order, 1990. It provides for these constitutional functionaries to be invited to Council meetings in the specified circumstances; the notification does not describe them as becoming permanent members of the Council.
According to the Gazette notification, the original Inter-State Council Order was published on May 28, 1990. It was subsequently amended on July 19, 1990, and December 24, 1996.
