New Delhi, May 21 (UNI) A Delhi court on Wednesday adjourned the hearing into a case against senior Trinamool Congress leaders for allegedly holding a protest in front of the Election Commission of India despite a prohibitory order in April last year.
The hearing was deferred following a plea by the counsels for the Trinamool leaders that they are yet to go through the charge-sheet
The Additional Chief Judicial Magistrate (ACJM) said, "Matter is listed for arguments on the point of charge. However, adjournment is sought by Ld. Counsels for accused persons on the ground that they are yet to go through the charge-sheet. Heard. Allowed".
"It is made clear that no further adjournment shall be granted," the court said.
The court accepted the personal bonds furnished by Trinamool leader Vivek Gupta.
Fixed deposits of Rs.. 10,000 each have been furnished as sureties by accused TMC leaders Abir Ranjan Biswash, Arpita Ghosh, Sudip Raha and Dr. Shantanu Sen. "Same are retained on record."
The court gave the next date of hearing on May 29
Delhi Police have alleged that the accused persons gathered outside the main gate of the Election Commission of India (ECI) and started protesting with placards and banners without a requisite permission and even though Section 144 (prohibiting gathering) of the Code of Criminal Procedure (CrPC) was in place.
In this matter the court earlier summoned TMC leaders Derek O'Brien, Sagarika Ghose, Saket Gokhle, TMC leaders Santanu Sen, Dola Sen, Nadimul Haque, Vivek Gupta, Arpita Ghosh, Abir Ranjan Bishwas and Sudip Raha to appear on April 30.
After perusal of the chargesheet as well as the complaint the court took cognizance of the offences punishable under Section 188 (disobedience to order promulgated by a public servant) 145 (unlawful assembly) and 34 (common intention) Indian Penal Code (IPC) and summoned all the accused persons, 2025.
TMC had announced the protest against central probe agencies CBI, NIA, ED and the Income Tax Department after meeting a full bench of the ECI to press their demand to change their chief.
It was alleged that the investigation agencies were targeting opposition parties at the behest of the BJP-led Centre. UNI XC SSP
