Srinagar Court convicts husband and two family members in 2022 murder of his wife

Srinagar, Oct 15 (UNI) The Court of Additional Sessions Judge, Srinagar, has convicted three members of a family in the 2022 murder case of Tasleema, who died under suspicious circumstances at her matrimonial home in Bemina, while acquitting two other accused for lack of sufficient evidence.
Court of the Additional Sessions Judge Farooq Ahmad Bhat convicted Tasleema’s mother-in-law, Hafeeza Begum, her brother-in-law, Parveez Ahmad Dar alias Bilal, and her husband, Shahnawaz Ahmad Dar, under Sections 302 (murder) and 120-B (criminal conspiracy) of the Indian Penal Code (IPC). The court acquitted the other two accused, Sumiya and Saika, giving them the benefit of doubt.
The court directed that Hafeeza Begum, who was on bail, be taken into custody and lodged in Central Jail, Srinagar.
Tasleema died on June 27, 2022, at her matrimonial home in Nund-Reshi Colony, Bemina. According to the prosecution, she was taken to JVC Hospital, Bemina, where she was declared dead. A post-mortem examination attributed her death to respiratory failure caused by smothering.
Following the initial inquiry into the circumstances surrounding her death, Police Station Batamaloo registered FIR No. 109 of 2022 and investigated the case. The prosecution alleged that Tasleema had faced matrimonial disputes and harassment over her inability to conceive, and that the circumstances of her death pointed towards a planned conspiracy.
The prosecution also relied on medical evidence, witness statements, call detail records and the conduct of the accused before and after the incident. The case was based on circumstantial evidence, as there was no eyewitness to the alleged murder.
During the trial, the prosecution examined 23 witnesses. The court considered the medical evidence, the circumstances in which Tasleema died inside her matrimonial home and the explanations offered by the accused in their statements.
In its findings, the court held that the prosecution had established a complete and unbroken chain of circumstances pointing towards the guilt of Hafeeza Begum, Parveez Ahmad Dar and Shahnawaz Ahmad Dar. It observed that the circumstances were inconsistent with any reasonable hypothesis of their innocence.
The court also concluded that the evidence indicated a meeting of minds among the three convicted accused to commit the crime, holding them liable for murder and criminal conspiracy.
However, the court found that the prosecution had failed to establish the charge under Section 201 IPC, relating to causing the disappearance of evidence or giving false information to screen an offender. It also held that the alleged cruelty under Section 498-A IPC had not been proved against the accused.
The acquittal of Sumiya and Saika, the two sister-in-law of the deceased, came after the court extended them the benefit of doubt. Their bail bonds were ordered to stand discharged.
