Tamil as official language in HC: MHAA challenges 1965 union Cabinet Committee decision

Chennai, Nov 1 (UNI) Challenging the Constitutional validity of the 1965 union Cabinet Committee's decision denying Indian languages other than Hindi and English as official languages of Constitutional Courts, the Madras High Court Advocates Association (MHAA) has filed a Public Interest Litigation petition in the High Court.
The 1965 decision placing Hindi on a pedestal, makes it clear that English should continue as the language of the Supreme Court and all High Courts till Hindi could replace it.
The PIL petition, filed by MHAA secretary S Arivazhagan, is coming up for hearing on Monday (Nov. 2, 2026) before the First Division Bench of Chief Justice SA Dharmadhikari and Justice G Arul Murugan.
The petition contends that the bar posed on Indian languages other than Hondi is violative of Articles 14 (right to equality), 19 (freedom of speech) and 21 (right to life). Hence, discriminatory.
On the delay in approaching the court decades later, MHAA submitted that it became aware of the 1965 decision, pursuant to the recommendations of a Chief Justices Conference, from an advocate who obtained it through an RTI application.
The PIL of MHAA also comes close on the heels of the Tamil Nadu Assembly's unanimous resolution in September pressing for making Tamil as the Official Language of Madras High Court, one if the four Chartered High Courts.
On Article 348 (3), empowering Governors, with the prior consent of the President, to authorise use of regional languages, the petition pointed out the the union Home Ministry maintains that the President could deny it.
While Gujarat, West Bengal and Karnataka were denied the use of the state languages in the respective High Courts, Rajasthan, UP, Madhya Parade and Bihar have been give the privilege of using Hindi, it was submitted.
A similar plea has been filed by the Advocates Association of Madurai Bench of Madras High Court.
