CAT issues show cause notice to J&K Additional Resident Commissioner

Srinagar, Mar 25 (UNI) The Central Administrative Tribunal (CAT), Srinagar, has issued a show cause notice to Additional Resident Commissioner, J&K, over allegations of interfering in judicial proceedings.

The CAT also directed him to refrain himself from “harassing” the employees who have petitioned the Tribunal for redressing their grievances.

The case stems from a petition filed by Nizamuddin Khan and against the General Administrative Department (GAD), challenging an impugned notification issued on February 13, 2025. The Tribunal had previously restrained the authorities from proceeding with the notification until further orders.

The applicants alleged that after approaching the court, they were served show cause notices by the Additional Resident Commissioner, demanding explanations within two days. They claimed that this was an act of harassment and retaliation, as some of them were later transferred and asked to vacate their official residences.
A bench comprising MS Latif , Member (J) and Prasant Kumar, Member (A) last week found prima facie evidence that the Additional Resident Commissioner’s communication to the Registrar Judicial of the J&K High Court sought to influence the proceedings.

The court observed that "no one is above the law" and warned against threatening or undermining judicial independence.

The CAT has now sought a detailed response from Anil Sharma and has listed the matter for the next hearing on April 8, 2025.
“The Additional Resident Commissioner, J&K Resident Commission, New Delhi is directed to provide the CCTV footage and other relevant documents, as mentioned by him in his show cause notice dated 21-02-2025, in a pen drive and in a sealed cover. We are exercising our suo moto powers for summoning the CCTV footage and other relevant documents as provided under Rule 88 of the Central Administrative Tribunal Rules of Practice, 1993 and before proceeding against the respondent-presently Additional Resident Commissioner, J&K Resident Commission, New Delhi, in accordance with the law for having prima facie committed contempt of this Court to issue a show cause notice upon him to file his detailed response,” the Tribunal order issued on March 18 read.

“At this stage, we would not like to comment on any proceedings which, in the estimation of the competent authority, are warranted in accordance with the law but however we direct the Additional Resident Commissioner, J&K Resident Commission to refrain himself from harassing the applicants in any manner which law would not countenance,” the order read.

The Tribunal asked registry to serve the show cause notice upon the Additional Resident Commissioner, J&K Resident Commission, New Delhi, Anil Sharma
It has also directed that a copy of the order be sent to the Chief Secretary of J&K and the Commissioner Secretary, Hospitality and Protocol Department.
