HC to hear petition on ban on Bahraich Dargah Jeth fair on Saturday

Lucknow, May 16 (UNI) The Lucknow bench of the Allahabad High Court will hear the petition challenging the ban on the Bahraich Dargah Jeth fair on Saturday.

The Chief Justice of the High Court, Arun Bhansali, on Friday constituted a special bench of Justice AR Masoodi and Justice Subhash Vidyarthi for urgent hearing of the case on Saturday at 2 PM.

State government's chief standing counsel Shailendra Kumar Singh said that the Chief Justice has ordered the constitution of a special bench on the petitioners' application for urgent hearing. Earlier, in the hearing of the case held on Friday, the petitioners did not get any relief in the case of a ban on the Jeth fair of Dargah Sharif in Bahraich.

The court had fixed the next hearing of the case for May 19. It was said on behalf of the petitioners that Jeth Fair is starting from May 18, so the case should be heard soon. Given this, the court had allowed the petitioners to give an application for an urgent hearing of the case to the Chief Justice.

A hearing was held on Friday on the petition filed by six people, including the chairman of the Dargah Sharif Management Committee of Bahraich, before the division bench of Justice A R Masoodi and Justice Ajay Kumar Srivastava - I.

On behalf of the state government, Chief Standing Counsel (CSC) Shailendra Kumar Singh opposed the petition, whereas, on behalf of the petitioners, their counsel Dr LP Mishra argued for permission to organise the fair.

The CSC said that after the permission of the court, the petitioners gave an application to the Chief Justice for an urgent hearing of the case. On which the Chief Justice ordered this special division bench on Saturday.

In the petition, the order of the DM of Bahraich dated April 26 has been challenged, in which permission has not been given this time for the Jeth fair held every year near the Dargah of Syed Salar Masood Ghazi.

The petitioner has requested the DM to direct him to permit the fair, calling it against the intention of the law. On the other hand, on May 8, the government lawyer opposed the petition, calling the DM's order appropriate. The court had given time to the parties, including the government, to submit their reply on the points raised in the petition by ordering to consider the application for interim relief be considered in the next hearing.

The court had said that it would not be appropriate to grant any interim relief until the reply of the opposite parties is sought in the case. The state government has filed its reply in the case, to which the petitioners have also submitted their reply.
