Prince Harry's U.S. immigration records unsealed

Washington D.C., Mar 19 (UNI) In a development drawing global attention, heavily redacted immigration documents pertaining to Prince Harry's U.S. residency status were released following a protracted legal challenge.
A debate over transparency reignited after a Freedom of Information Act (FOIA) lawsuit shedding light on celebrity privilege and immigration compliance.
A revelation made in his memoir "Spare" sparked controversy regarding past illicit drug use. The disclosure was ordered by Judge Carl Nicholas, who had previously dismissed calls for transparency, citing insufficient public interest, but reversed course under mounting pressure from the Heritage Foundation, a conservative think tank.
The Foundation filed a FOIA request in May 2023, questioning how Prince Harry, 40, secured lawful entry into the U.S., in 2020, despite his candid admissions of consuming cocaine, cannabis and hallucinogenic mushrooms. U.S. immigration law deems individuals inadmissible if they are identified as drug abusers or addicts, unless they can demonstrate the condition is in remission, according to a report by PEOPLE.
According to Time, the DHS denied the FOI request in June 2023 and asked for the case to be dismissed, arguing that immigration records are traditionally exempt from FOIA.
The Telegraph reported in February 2024 that lawyers for the Biden administration also pushed back against the request, arguing that visa applications are “private personal information.” The outlet reported that John Bardo told the court, “Saying something in a book doesn’t necessarily make it true.”
Despite the redacted release, questions persist regarding the visa category under which Prince Harry entered the country in 2020. While his wife Meghan Markle, 43, holds U.S. citizenship, Prince Harry's immigration status remains undisclosed, fueling speculation.
In February 2024, President Donald Trump told the Daily Express that he "wouldn't protect" Prince Harry regarding scrutiny around the confidential shroud around his immigration status. "I wouldn’t protect him… He would be on his own if it was down to me," Trump added.
In an interview that aired on Good Morning America last year, Prince Harry said he’s “considered” becoming a U.S. citizen. "I'm here standing next to this with these guys and the American citizenship is a thought that has crossed my mind but certainly not something that is a high priority for me right now," Harry said, emphasising his focus on the Invictus Games countdown event then.
Should Harry pursue naturalisation, USCIS policy mandates that any applicant with hereditary titles must formally renounce such honors during the Oath of Allegiance, signaling exclusive loyalty to the U.S. Constitution.
According to the agency, "Failure to renounce the title of position shows a lack of attachment to the Constitution."
This requirement could place Harry in a difficult position, forcing him to publicly relinquish his royal designation if he seeks American citizenship — a move likely to provoke controversy both in the U.K. and abroad. UNI XC SSP
