APWWS urges Govt to set up child-friendly Special POCSO Courts in Arunachal

Itanagar, June 14 (UNI) The Arunachal Pradesh Women’s Welfare Society (APWWS) has urged the State Government for the establishment of separate child-friendly Special Courts under the Protection of Children from Sexual Offences (POCSO) Act, 2012 in the State capital and across various districts of Arunachal Pradesh.
In a representation submitted to the Commissioner (Law), Govt of Arunachal Pradesh, the APWWS said while District and Sessions Courts and Additional Sessions Courts have been designated as Special POCSO Courts under Section 28 of the Act, the lack of appropriate child-sensitive infrastructure and environment continues to hamper the effective delivery of justice.
“Despite the Act being in force for over a decade, Arunachal Pradesh still lacks the necessary facilities to ensure a child-sensitive legal process....The absence of separate waiting rooms and dedicated facilities frequently results in traumatic encounters between child victims and the accused. In several instances, child victims have come face-to-face with alleged perpetrators due to inadequate infrastructure, severely compromising their mental and emotional well-being,” the Society said.
"The very objective of the POCSO Act—to ensure a child-friendly, speedy, and confidential legal process—is defeated in the absence of essential support infrastructure," the APWWS said.
APWWS strongly urged the Law Department to take immediate steps toward establishing separate child-friendly Special Courts, beginning with the Capital Complex and extending across all districts in a phased manner.
These courts must strictly comply with POCSO guidelines and should have separate entry and exit points for victims and accused, dedicated waiting rooms with child-friendly amenities, counselling rooms staffed with trained child psychologists and social workers, and video conferencing facilities to eliminate direct confrontation with accused.
It also called for in-camera trial settings ensuring complete privacy and confidentiality, separate bathroom facilities for child victims, designated support persons as mandated under the Act, and child-friendly furniture and courtroom to prevent direct confrontation.
Calling the situation “urgent and overdue”, the APWWS emphasized that every day of delay increases the risk of secondary trauma to child victims seeking justice. The establishment of such courts, it said, will not only fulfil statutory obligations but also reflect the state’s commitment to upholding children’s rights and dignity.
