Calcutta High Court stays order allowing CPI(M) book stalls at Bangaon during Durga Puja

Kolkata, Oct 16 (UNI) A Calcutta High Court Division Bench on Friday stayed a single-bench order permitting the CPI(M) to set up book stalls at Bangaon in North 24 Parganas district during Durga Puja, observing that the party had not obtained permission from the administration.
The Division Bench of Chief Justice R. V. Ghuge and Justice Md. Shabbar Rashidi, while passing the interim order, also rejected the Communist Party of India (Marxist)'s plea to sell books using only a table and chair under an umbrella.
During the hearing, Chief Justice Ghuge asked CPI(M) counsel Shamim Ahmed whether the party had obtained permission to set up the stalls.
Ahmed told the Bench that although the party had not obtained permission from the government, it had informed the sub-divisional officer (SDO) concerned about its plans. He said permission had not been sought in previous years either, despite around 100 stalls being set up annually.
The Chief Justice observed that the law could not be left unenforced this year.
The Bench also observed that stalls belonging to the Hindu Jagaran Manch would face removal if they had been set up without permission. The police were directed to take appropriate steps to remove unauthorised stalls.
The matter will be heard next on January 21.
