Fadnavis says state govt has no powers to sack MPSC Chairperson

Mumbai, Oct 6 (UNI) Maharashtra Chief Minister Devendra Fadnavis stated here on Tuesday that the Maharashtra state government has no power to remove Maharashtra Public Service Commission (MPSC) Chairperson Vivek Bhimanwar from his post.
“It is not in the hands of the state government to remove the MPSC chairman or make him tender his resignation. According to the rules, only the President can remove him after a recommendation from the Supreme Court. This is mentioned in the Constitution. Everyone is aware of this,” Fadnavis stated while interacting with media persons here.
Chief Minister Fadnavis said that the current President (Droupadi Murmu) had not assumed office when the MPSC question paper leaked.
“We should also consider how appropriate it would be to demand that the President of India be asked to remove the MPSC Chairperson who was appointed to office after the question paper leaked,” Fadnavis stated.
“Despite this, the state government has come forward and said that we are ready to investigate the current MPSC Chairperson as well as its former chairpersons to instill confidence in the minds of the students. If any maladministration is revealed in that investigation as per Article 317, we will not hesitate to make a recommendation to the President of India. In this regard, the state government has also requested the Governor of Maharashtra,” Fadnavis said.
Fadnavis criticised the opposition parties leading the protest by MPSC aspirant students, saying that it is wrong to score political points even after all the demands of the students have been accepted.
“How appropriate would it be to ask the President of India to remove an MPSC Chairperson during whose tenure there was no paper leak? And how is it possible to request the MPSC Chairperson without holding any inquiry,” Maharashtra Chief Minister Devendra Fadnavis said.
Meanwhile, the MPSC aspirant students’ agitation against repeated Maharashtra Public Service Commission (MPSC) question paper leaks, which is presently being led by Sharad Pawar-led NCP MLA Rohit Pawar, is likely to intensify as Leader of Opposition Rahul Gandhi is expected to arrive in Pune on Wednesday, October 7 or Thursday, October 8 and meet the students, sources said here on Tuesday.
On Monday, Maharashtra Chief Minister Devendra Fadnavis recommended the formation of a special judicial committee to investigate the former and current chairman, as well as members of the Maharashtra Public Service Commission (MPSC), under Article 317 of the Constitution.
Yet, the move has fallen short of the demand by protesting students and MPSC aspirants to sack the present MPSC Chairman Vivek Bhimanwar, who is alleged to have close ties with Chief Minister Devendra Fadnavis.
Opposition figures like Uddhav Thackeray-led Shiv Sena Rajya Sabha MP Sanjay Raut, Sharad Pawar-led NCP MLA Rohit Pawar and Maharashtra Congress president Harshvardhan Sapkal have alleged several times that MPSC Chairman Vivek Bhimanwar has close ties with Chief Minister Devendra Fadnavis. They have questioned why no action has been taken against Bhimanwar, who is allegedly the kingpin behind the MPSC question paper leak.
On Sunday, Uddhav Thackeray-led Shiv Sena Rajya Sabha MP Sanjay Raut as well as Cockroach Janta Party (CJP) founder Abhijit Dipke met the protesting students in Pune and on Monday, Maharashtra Navnirman Sena (MNS) founder Raj Thackeray reached Pune and met the agitating MPSC aspirants.
According to sources, the move by Fadnavis to set up a special judicial commission, without sacking present MPSC Chairman Vivek Bhimanwar is being considered as an eyewash by many students, especially by those who are not aware of legal norms that need to be followed before taking such a step.
