Maharashtra Waqf Tribunal declines immediate stay on Khilafat House construction work, Next hearing on Oct 9

Mumbai, Oct 6 (UNI) The Maharashtra Waqf Tribunal declined to immediately stop construction and renovation work at Mumbai’s historic Khilafat House. After hearing arguments, it adjourned the case to October 9 and said the government should be added as a party so its position can be heard.
Social activist Shahid Mansoori, the petitioner, argued that the plot is Waqf property and that construction cannot proceed without permission from Waqf authorities. His lawyer presented a list that included the plot and sought an immediate stay.
Khilafat House’s lawyer opposed the petition, arguing that it was brought for financial benefit and that the petitioner had no authority to stop the work. He said the land belongs to the state government and was leased to Khilafat House, and that the construction is for educational purposes. The committee denies plans for a hotel or other commercial activity and says the project will benefit the public.
The dispute follows a Waqf Board notice asserting that the plot is Waqf property and requires permission for construction. The All India Khilafat Committee challenges the notice, arguing that it is a public trust registered with the Charity Commissioner, that the government owns the land, and that its Waqf listing and registration were made without proper inquiry or notice. It cites a 1964 court order and a 2023 government lease in support of its position.
Construction is taking place at the Khilafat College building adjoining Khilafat House. While work continues, classes for female students are being held temporarily at nearby Imamwada Municipal School. The committee says it has operated teacher training and Urdu D.Ed. courses since 1989.
