Karnataka Cabinet to discuss HC verdict striking down enhanced SC/ST quota

Bengaluru, Oct 13 (UNI) The Karnataka Cabinet will discuss the High Court verdict striking down the enhanced reservation for Scheduled Castes (SCs) and Scheduled Tribes (STs) and decide on the next course of action, including the possibility of challenging the order in the Supreme Court, Deputy Chief Minister G Parameshwara said on Tuesday.
Parameshwara said the state government would examine all legally permissible options in consultation with the Advocate General and the Law Department before taking a final decision on the matter.
The Karnataka High Court on Monday struck down provisions of a 2022 state law that increased reservation for SCs from 15 per cent to 17 per cent and for STs from three per cent to seven per cent.
The court held that the enhanced quota breached the 50 per cent ceiling on reservations laid down by the Supreme Court in the landmark 1992 Indra Sawhney versus union of India judgment, a principle subsequently upheld in several rulings.
The verdict has implications for reservation in educational admissions and government appointments, where the enhanced quotas had been introduced following the state government's decision to increase the share of reservations for the two communities.
The Cabinet is expected to consider the legal and administrative implications of the ruling before deciding whether the state should approach the Supreme Court for relief.
The state government's next steps will be closely watched by beneficiaries of the enhanced quota, as well as educational institutions and government departments implementing reservation provisions.
The 2022 legislation had raised the SC quota by two percentage points and the ST quota by four percentage points, taking their combined reservation from 18 per cent to 24 per cent.
The High Court's decision has brought the validity of the enhanced reservation framework into question, leaving the state government to assess its options within the existing constitutional and judicial framework.
Further action will depend on the Cabinet's deliberations and the legal advice received by the government.
