Madras HC refuses CBI probe into Veeramani POCSO case, says SIT should be given time to investigate

Chennai, Sep 30 (UNI) The Madras High Court on Wednesday refused to order a CBI probe into the POCSO case involving granite baron and paedophile accused R.Veeramani of Gem Granites saying the Special Investigation Team (SIT) formed by the Tamil Nadu government should be given breathing space to collect all the evidences in the case.
Hearing a plea fied by one Varahi seeking to transfer the probe from the State police to the CBI, Mr Justice V.Lakshminarayanan observed that the Tamil Nadu police did not have a crystal ball or a magic wand to get all the evidence at once, adding that the SIT should be permitted to carry on with the probe.
"Even if transfer the probe to the CBI, does the authorities are going to come from Africa...don't you have faith in Tamil Nadu Police", the Judge asked.
"The SIT was formed hardly 4 days back and now your asking for a CBI probe. I'm sure TN police does not have a crystal ball or magic wand to get all evidence at once. Investigation takes time, especially as in the present case..Be that as it may, as on today, an SIT has been formed and it has commenced investigation. Even without giving them breathing space, asking to transfer probe to CBI will not be proper," the Judge said.
After the POCSO court rejected the closure report and ordered to probe the matter based on the FIR registered in October 2025, cases were registered against Veeramani and others under Secs 7,8,15(1), and 21(1) of the POCSO Act, Sections 354(A), 354(C), 201, and 120(B) of IPC and Sections 66(E), and 67(B) of the IT Act.
Police have so far arrested four people, including the tainted bizman, his acquaintance Shanthi and her husband Mahendra Simkan and Veeramani's long time former staffer Ganesan, from whom police police hve recovered videos puroportedly containing the inappropriate acts of the industrialist. He was arrested for not sharing the videos to the investigating authorities and also to ascertain the source from which he had received it.
All the four were in judicial remand and the High Court has reserved its orders on the bail plea of the arrested couple. The probe so far by the CCB police has unravelled several startling revelations including huge money trial running to crores of rupees and the involvement of top police officials and also some affluent and influential persons.
Taking up the plea for hearing, the Judge questioned the genuineness of the plea and orally remarked that the issue involved a sensitive case, involving children, some of whom belonged to the Scheduled caste community. "It's a sensitive matter. I'm more concerned about the children. You can't politicise it. You're not understanding the seriousness of it. There are other cases in which you can get publicity. Please don't use this. There are a lot of children belonging to SC/ST communities," the court observed.
When the petitioner pointed out that there was an apprehension that an independent investigation would not be carried out in the case and that the investigating team was keeping silent with respect to evidence against some high-ranking officials, the court wondered how such allegations could be made without giving time for the SIT to conduct an investigation.
"We'll transfer it to the FBI. Totally independent. Out of India. How can you say they're keeping silent? This is a publicity interest litigation. Four women officers have been appointed. Why are you interfering without giving them an opportunity to investigate? I think this is at the instance of the accused. You have some axe to grind with the previous regime. Don't use kids for that," the court said in its oral observations.
When the petitioner informed the court that he had evidences to show involvement of some persons, the judge said evidences if any should be handed over the SIT by 3.00 p.m. tomorrow and also asked the SIT to file an inquiry/status report on October three and adjourned the matter to that date.
A couple of days back, Senior counsel N L Rajag, made an urgent mention before the First Bench comprising Chief Justice S.A.Dharmadhikari and Justice G Arul Murugan and said videos connected with the case had surfaced and that senior police officials involved in the earlier investigation had been shunted out and placed on compulsory wait.
He also requested the court to hear the case urgently, considering the sensitivity of the case, and submitted that objectionable videos in connection with the case were being broadcast by media outlets, in violation of the POCSO Act.
The Judges observed that a Special Investigation Team (SIT) had already been constituted by the Tamil Nadu government to probe the case and said the police could continue their investigation. They said the matter could be taken up for hearing if it was filed in the form of a petition and mentioned for listing. After the petition was filed and listed, it was taken up for hearing toay.
