Mamata TMC’s plea for urgent release of funds rejected by Calcutta HC

Kolkata, Oct 5 (UNI) Former Chief Minister Mamata Banerjee's TMC has moved the Calcutta High Court seeking an urgent hearing to access funds for pending employee salaries, office rent and other essential expenses after a court-appointed special officer declined to release the money.
However, the court rejected the party’s plea for an immediate hearing. Justice Saugata Bhattacharyya said the matter would be taken up in the normal course after the Puja vacation.
According to TMC sources, a committee headed by retired Justice Subrata Talukdar, which oversees the party’s bank accounts, has refused to release funds required for essential expenses ahead of the festival.
The special officer has also sought written clarification on whether the Election Commission’s order restricting the use of the party’s name and the ‘Jora Phool’ symbol applies only to the by-elections or will remain in force indefinitely.
The dispute follows police action over alleged financial irregularities involving three TMC accounts in a private bank. After the accounts were frozen, the matter reached the High Court.
On July 9, the court directed that while the Mamata TMC would not have full control over the accounts until January 29 next year, funds required for routine organisational activities and employee salaries should be released through the special officer.
A fresh legal complication arose after the Election Commission temporarily barred the Mamata and Ritabrata Banerjee camps from using the name ‘All India Trinamool Congress’ and the party symbol.
Additional Advocate General Rajdeep Majumdar, appearing for the state, argued that since the Election Commission had suspended the party’s legal existence under that name, the petition filed in its name was not maintainable.
During a hearing in September, however, Justice Bhattacharyya’s bench observed that the Election Commission’s order was an interim measure linked to the by-election and did not amount to a final decision.
The court therefore maintained its earlier position, allowing the Mamata TMC to use funds for day-to-day expenses until January 29.
With the special officer now withholding the funds and the High Court declining an immediate hearing, the Kalighat leadership faces uncertainty over meeting essential expenses just before Durga Puja. UNI SAG AAB
