Meghalaya HC issues notice to Governor's PS over GHADC electoral rules

Shillong, Oct 8 (UNI) A Division Bench of the Meghalaya High Court on Thursday heard a writ petition challenging the constitutional validity of the electoral rules of the Garo Hills Autonomous District Council (GHADC), which restrict participation in council elections exclusively to native tribal communities.

The petition, filed by Mozidul Rahman, was heard by a Bench comprising Chief Justice/Justice Hamar Singh Thangkhiew and Justice B. Bhattacharjee.

During the hearing, the Court directed that notice be issued to the Principal Secretary to the Governor by registered post with acknowledgement due within one week.

R. Colney, the government advocate accepted notice on behalf of Chief Secretary and Commissioner and Secretary of District Council Affairs department who are representing the Meghalaya government, while Sujit Dey appeared for Chief Executive Member and Secretary of GHADC.

The Bench noted that no further notice was required to be served on these respondents, following submissions by Rahman’s legal counsel, Phuyosa Yobin.

During the hearing, Yobin requested an accommodation due to the absence of the arguing Senior Counsel, Salman Khurshid.

He also submitted that a similar writ petition had been filed but was yet to be listed, and he prayed that the same be listed together with the instant matter on October 29, 2026.

The prayer was granted by the court.
