ECI declares Agra Teachers’ Constituency poll at three booths void, orders fresh voting on October 26

New Delhi, Oct 24 (UNI) The Election Commission of India has declared the polling held at three polling stations in the Agra Division Teachers’ Constituency of the Uttar Pradesh Legislative Council election on October 23 void and ordered a fresh poll on October 26, following irregularities and lapses that vitiated the electoral process.
In an order issued on Saturday, the Commission directed that re-polling be conducted at polling stations Nos. 20, 21 and 26 between 8 am and 4 pm on Monday under Section 58A(2)(a) of the Representation of the People Act, 1951.
The decision followed a communication from the Chief Electoral Officer of Uttar Pradesh dated October 24, seeking the Commission’s consideration of the matter.
The Commission has directed the state election machinery to make all necessary arrangements within the stipulated timeframe and ensure that the fresh poll is widely publicised across the constituency.
All contesting candidates, the media and the Election Commission’s observer must be informed of the revised polling schedule.
In a significant measure to prevent a recurrence of the alleged lapses, the Commission has specifically instructed the authorities not to deploy for election duties during the re-poll any individuals found to have been involved in unlawful activities that may have contributed to the irregularities. It has also directed that indelible ink be applied to the right-hand forefinger of every elector casting a vote in the fresh poll, as part of the safeguards intended to protect the integrity of the voting process. The counting of votes will not begin automatically after the re-poll.
The Commission has stipulated that fresh permission must be obtained before counting can commence, after polling at all three stations has been completed successfully. The request must be submitted in the prescribed format specified in the Commission’s letter dated October 12. Separately, the Commission has directed the Divisional Commissioner, Agra, to conduct an immediate inquiry into the incidents that necessitated the fresh poll and fix responsibility for the lapses.
The inquiry must identify those responsible, including any police personnel and polling officers found to have been involved in the irregularities. The report has been sought by October 25, leaving the authorities with a narrow window to establish accountability before voting resumes on Monday.
The order reinforces the Election Commission’s powers under the Representation of the People Act, 1951, to declare a poll void and direct fresh voting in circumstances covered by the law. By ordering a re-poll, restricting the deployment of potentially implicated personnel and seeking an inquiry into the conduct of officials, the Commission has sought to safeguard the credibility of the electoral process while ensuring that responsibility for the lapses is established.
