SC declines relief to TMC over frozen bank accounts, asks Calcutta HC to expedite hearing

New Delhi, Oct 1 (UNI) In a setback to the Mamata Banerjee-led Trinamool Congress, the Supreme Court on Thursday declined to grant any relief against the freezing of four of the party’s bank accounts by the State police and instead asked the Calcutta High Court to expedite the proceedings pending before it.

A bench comprising Justice M.M. Sundresh and Justice P.B. Varale refrained from examining the challenge on its merits, noting that the Election Commission of India had, through an interim order, frozen the party’s name and symbol and that the larger dispute over which TMC faction would be entitled to the party name and symbol, and consequently to operate the funds, remained unresolved.

The court declined to exercise its jurisdiction under Article 136 of the Constitution and requested the High Court to take up the matter expeditiously.

On August 11, the Supreme Court had declined to interfere with an interim arrangement made by the Calcutta High Court permitting operation of certain accounts for meeting the party’s day-to-day expenses. The present appeal concerned four Indian Bank accounts in respect of which the High Court had not granted relief.

Appearing for the TMC, senior advocate Abhishek Manu Singhvi submitted that the freezing of the accounts had severely affected the party’s functioning. He argued that the present four accounts were distinct from three HDFC Bank accounts that had earlier been permitted to be operated under the supervision of an administrator.

Singhvi said the party required about ₹12.15 crore every month for its functioning and submitted that restricting access merely to day-to-day expenditure was insufficient, particularly with by-elections approaching. When the bench suggested that the court-appointed administrator could also oversee the four accounts, Singhvi accepted the suggestion.

Solicitor General Tushar Mehta, however, referred to the internal dispute within the party and submitted that the Election Commission should first be allowed to decide the competing claims. He also referred to an ongoing investigation concerning an alleged cash deposit of ₹35 crore into certain accounts.

Senior advocate K. Parameshwar, appearing for a complainant, submitted that expenditure necessary for day-to-day functioning had already been permitted.

Singhvi maintained that the Election Commission proceedings concerned the party’s name and symbol and not its bank accounts, and argued that the present freezing action was independent of that dispute.

The bench, however, remained unconvinced and declined to grant any relief, asking the High Court instead to expedite the proceedings.
