Allahabad HC orders demolition of two Gulmohar Greens Towers in Ghaziabad, two floors of four others to go

Prayagraj, Oct 28 (UNI) In an unprecedented judgement, the Allahabad High Court has cracked down on illegal construction in Ghaziabad's Gulmohar Greens Society.
A division bench of the court ordered the complete demolition of two towers of the society and the demolition of 2 floors of four towers.
The bench of Justice Saral Srivastava and Justice Sudhanshu Chauhan issued the order on Wednesday.
The court ordered the Ghaziabad Development Authority (GDA) to completely demolish the society's illegal towers, No. 27 and 28.
Besides, the 9th and 10th floors, illegally constructed on top of towers No. 16, 17, 18, and 19, will be demolished within two months, the court ordered.
The entire demolition cost will be recovered from the promoter as land revenue arrears and the police and administration will provide security to the GDA.
Besides, the court also imposed a heavy fine of Rs 25 lakh on the builder and the amount must be deposited in the GGRWA's account within one month.
The court also reprimanded the negligent GDA. The court stated that due to the negligence of GDA officials, residents have suffered.
The court ordered that the GDA will pay a cost of Rs. 50,000 to each petitioner. The court also ordered an FIR against the promoter within two weeks. An FIR will be filed against the builder for fraud and violation of the UP Apartment Act.
Besides, an Additional CP-level officer will investigate the entire matter. The court declared the third compounding action completely illegal.
The court expressed strong displeasure over the lack of a fire NOC and completion certificate. Investigating officer Surendra Singh, who gave the builder a clean chit in the FIR filed in 2018 without investigation, was immediately suspended and a departmental inquiry was ordered.
The builder will return the money to 85 buyers with 10 per cent interest, the court said. UNI MBD NST ARN
